02/ 13.04.2026: Heard learned counsel for the petitioners and learned
counsel for the State and learned counsel for the informant.
2. The petitioners are apprehending their arrest in connection with
Complaint Case No. 1264 of 2021, registered under sections 406, 420,
120(B) of I.P.C, pending in the Court of learned Chief Judicial Magistrate at
Garhwa.
3. Since the case arises out of complaint there is no question of
custodial interrogation. Further cognizance has been taken and summons
have been issued and in view of the judgment passed by the Hon’ble
Supreme Court in the case of “Arnesh Kumar Vs. State of Bihar“
reported in (2014) 8 SCC 273 and “Satender Kumar Antil Vs. CBI and
( 2026:JHHC:10528 )Anr. reported in (2022) 10 SCC 51 the petitioners are directed to
surrender before the trial court since there is no question of arrest in this
case and take appropriate steps.
4. This anticipatory bail allocation is disposed of.
