1. The instant anticipatory bail application has been filed under

Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023

(B.N.S.S.) by the petitioners apprehending their arrest in

connection with FIR No.132/2021, Police Station Siwana,

District Balotra for the offences under Sections 420, 467, 468,

471, 447 and 120-B of IPC, 1860.

2. Learned counsel for the petitioners submits that the

petitioners are the Ward Members of Gram Panchayat, Mokalsar

and that only the signatures and thumb impression of the Ward

members were affixed on the lease deed and they are not

beneficiaries of the same in any manner. He further submits that

they have not been named in the FIR and there are no specific

allegations of forgery against them. He further submits that

petitioner No.1-Dhepidevi and No.2-Hemlata are ladies aged 79

and 65 years old, respectively, and petitioner No.3-Gomaram, is

also aged about 75 years old, and that they have already joined

the investigation as per the directions given by this Court,

therefore, no useful purpose would be served by sending the

petitioners behind bars or for custodial interrogation; he therefore,

prays that the petitioners may kindly be released on anticipatory

bail.
