1. Heard on interim stay application.

2. The submission of learned counsel for the petitioners is that

initially, there was a Labour Court award directing the

reinstatement of non-applicant and grant of 40% back wages. The

same was challenged before the Single Bench of this Court and

the Single Bench has refused to interfere. Such order has been

again challenged before the Division Bench and Division Bench

also refused to interfere with regard to award of the Labour Court,

however, an option is given to both parties that the lump-sum

amount may be given in lieu of reinstatement.

3. It appears that the petitioners herein have calculated the

40% of wages as granted by the Labour Court and also offered a

lump-sum amount of Rs.5,80,350/- together with interest which

was arrived at Rs.8,79,554/- in total.

4. The non-applicant herein has accepted the said proposal by

addressing a letter dated 14.02.2019 and in fact, this submission

was also recognised by the Division Bench in contempt

proceedings.

5. Having settled the matter, an application filed before the

Labour Court under Section 33 (C)(2) of Industrial Disputes Act,

1947 by the workman earlier was continued. The said application

has been continued in spite of full satisfaction of the claim of the

workman.

6. Prima facie, this Court is satisfied that the proceedings

before the Labour Court are finally settled, therefore, in such

circumstances, there shall be a stay on further proceedings

pursuant to the order dated 15.12.2025 (Annex.1).

7. Issue notice to the respondents, returnable in four weeks.

8. List the matter on 20.05.2026.
