    Representation/Report dated 04.05.2026 and pass

    direct the Respondent No. 4/ Station House Officer to Provide Police

    ORDER:

    The Writ Petition is filed under Article 226 of the Constitution of India

    seeking the following relief:

    “…to issue a Writ, order or direction more particularly in the nature of
    Writ of Mandamus declaring the action of the Respondent No. 4 /
    Station House Officer in not taking action on the Petitioners
    Representation/Report dated 04.05.2026 submitted for taking
    necessary action against the Respondent No. 6 to 12 as illegal,
    arbitrary, capricious and contrary to the provisions of BNSS and violation
    of the fundamental rights guaranteed under the Articles 14, 21, 25 and
    26 of the Constitution of India and consequently direct the 4th
    respondent to take necessary action on the Petitioners
    Representation/Report dated 04.05.2026 …”

    2. Heard Mr. Penumaka Venkata Rao, learned counsel for the Petitioners

    and Mr. P. Ajay Babu, learned Assistant Government Pleader for Home.

    3. Mr. Penumaka Venkata Rao, learned counsel for the Petitioners,

    submits that the Petitioners filed a Representation dated 04.05.2026 before

    the Station House Officer, Hanuman Junction Police Station, Krishna District,

    alleging that a group of outsiders and non-church members entered the

    church premises on 26.04.2026 and 03.05.2026 and created disturbance in

    the Church Administration, and claimed authority over the said Church. The

    Petitioners asserts that they are the elected members of the Triennium

    Committee (2025-2028) and that disputes have arisen regarding transfer of

    Church Administration and Committee Control. It is alleged that the said group

    forcibly took charge of the Church, attempted to enter the premises and

    threatened the Petitioners with dire consequences. As such, the Petitioners

    sought police intervention to safeguard the rights of the elected Church

    Committee. Hence, the Writ Petition.

    4. Mr. P. Ajay Babu, learned Assistant Government Pleader for Home, on

    written instructions, submits that the representation dated 04.05.2026 was

    duly entered in the Station General Diary and upon enquiry, it was found that

    the grievance relates to Church Administration and Committee Control. A civil

    Suit vide O.S.No.139 of 2026 is pending on the file of the learned Civil Judge

    (Junior Division), Nuzvid, seeking permanent injunction restraining

    Respondents Nos.6 to 9, 11 and 12 from obstructing the plaintiff in attending

    the Holy Zion Church at Bapulapadu. Since the dispute pertains to Church

    Administration, which is civil in nature, and as the issue is pending

    adjudication before the competent Civil Court, the police expressed their

    inability to take further action in that regard.

    5. However, learned counsel for the Petitioners submits that interference

    by Respondents, who are non-church members, is creating a law and order

    problem in the locality.

    6. Considering the facts and circumstances of the case, in the event of any

    law and order problem, the Respondent Police are directed to initiate

    appropriate action to deal with the situation, if any cognizable offence is

    committed by any of the members or groups, and it is left open to the Police to

    take appropriate legal action, in accordance with the law, with a view to

    maintain public peace and tranquillity in the said locality.

    7. Accordingly, the Writ Petition is disposed of. There shall be no order as

    to costs.

    As a sequel thereto, interlocutory applications, if any, pending shall

    stand closed.
