By this petition, the petitioner seeks quashing of the FIR
registered with the Madanrting Police Station on 28.04.2004 for
the alleged offences punishable under Section 399 IPC read with
Section 25 of the Arms Act.
Learned counsel for the petitioner submits that although
charge-sheet was filed way back in 2004, there has been no
progress in the case till date. Hence, learned counsel for the
petitioner seeks quashing on the ground of delay in the conduct
of the trial and also on merits.

Mr S. Sentupta, learned Addl. PP waives notice on behalf
of the sole respondent and seeks time to take instructions.
In the meantime, Registry to call for the record as well as
a report from the concerned Court where the petitioner’s case is
pending i.e., Session Case No. 34/2026 before the Court of
Additional Deputy Commissioner (Judicial) Shillong. The report
to contain the reason for delay and the copy of the Roznama, if
any.
