    The plaintiff has filed this suit against defendants seeking

    partition and separate possession of 1/6 share of the plaintiff in

    the suit schedule property by metes and bounds, holding that the

    partition deed dated 28.09.2012 entered into between defendants

    No.1 to 3 is not binding on her share and for permanent injunction

    restraining the defendants from alienating the suit schedule

    property.

    (a) The propositus of the family of plaintiff and defendants

    is Sri Y. Balakrishnappa @ Y. Balakrishna. Smt.Lakshmamma

    was the wife of Sri Y. Balakrishnappa @ Y. Balakrishna. Out of

    their wedlock, they got six children. They are Smt. Kamalamma,

    who is the mother of defendants No.6 to 8, defendant No.1- Sri B.

    Nagaraj, Sri B.K. Krishnamurthy, who is husband of defendant

    No.3 and father of defendants No.4 & 5, defendant No.2- B.S.

    Sathyanarayana, who died leaving behind defendant No.2(a) to
