2. Learned counsel for the applicants
submits that the marriage between
applicant no.1 and respondent no.2 was
solemnized on 18.02.2024, however,
respondent no.2 resided in the
matrimonial home only for a period of
three days and thereafter left the same
without any sufficient cause. It is
contended that, with an intent to harass
and victimize the applicants, respondent
no.2 has initiated multiple proceedings
against them, including lodging of an
F.I.R. dated 20.05.2025 under Section
115(2), 351(2), 352 & 85 I.P.C. and
Section 3/4 of Dowry Prohibition Act, in
which investigation is presently pending.
He further submits that respondent no.2
has also instituted proceedings under
Section 144 of the Bharatiya Nagarik
Suraksha Sanhita seeking maintenance
against applicant no.1. Apart from the
same, she has also filed an application
under Section 12 of the Dowry
Prohibition Act against the applicants. It
is also submitted that applicant no.1 has
already instituted a divorce petition
under Section 13(1) of the Hindu
Marriage Act. It is thus argued that
despite having lived in the matrimonial
home for a very brief period, respondent
no.2 is continuously initiating multiple
litigations on the same set of allegations,
thereby subjecting the applicants to
undue harassment and multiplicity of
proceedings.
4. Issue notice to respondent no.2,
returnable at an early date.
5. List the matter after receipt of the
service report.
6. Considering the submissions
advanced by learned counsel for the
applicant, it is directed that, till the next
date of listing, further proceedings of
Complaint Case No.251 of 2025, pending
before the Court of learned Judicial
Magistrate, Ramnagar, District Nainital,
shall remain stayed.
7. Stay application (I.A. No.1 of 2026)
stands disposed of.
