    3. In this case, a complaint was filed by
    respondent no. 2 wherein she has alleged
    that the applicants were keeping enmity
    with her on the pretext that she had
    earlier lodged a complaint against them on
    21.06.2022. As per the complaint, the
    applicants entered her house and beat her
    with sticks and she was also pregnant at
    the relevant time. The applicants also tried
    to commit rape upon her. Now, statement
    has been given by her to the Police by
    hiding the facts stating that only
    altercation took place between applicants
    and respondent no. 2.

    4. Learned counsel for the applicants
    would submit that on the complaint dated
    21.06.2022 filed by respondent no. 2,
    Police had filed its final report in which
    Police found that the applicants and
    respondent no. 2 are neighbours and there
    are dispute relating to trivial issues.

    5. Issue notice to respondent no. 2,
    returnable within three weeks. Steps to be
    taken within a week.

    6. Having heard the submission, this
    Court is of the view that this matter
    definitely requires deliberation.

    7. List this matter after service report is
    received.

    8. In the meantime, counter-affidavit(s),
    if any, be filed by the respondents.

    9. After perusing the records and having
    heard learned counsel for the parties, this
    Court, prima facie, is of the opinion and is
    satisfied that in the interest of justice,
    further proceedings of Complaint Case No.
    1450 of 2023, Nargis Vs. Aslam and
    Others
    , under Sections 323, 452 and 504
    of IPC, pending in the court of learned
    Judicial Magistrate II, Roorkee, District
    Haridwar, shall remain stayed qua the
    applicants till the next date of listing.
