Due to paucity of time, the matters could not be taken up for final
hearing today. However, Mr. Sunil Sethi, learned Senior counsel appearing on
behalf of the respondents in OWP No. 107/2009, submitted that certain matters
are covered by the judgment passed by this Court in OWP No. 90/2019 titled
Building Operation Controlling Authority Vs. Nageen Ara. He, therefore,
requested that, at the first instance, those maters covered by the said judgment

be taken up for consideration, and the remaining matters be segregated so that
an endeavour is made to hear all the clubbed petitions together.
In view of the statement made by Mr. Sethi, this Court deems it
appropriate to list all the clubbed petitions on 25.03.2026 in the supplementary
list. On that date, learned counsel for the petitioner shall furnish a detailed list
of matters covered by the aforesaid judgment of this Court.
In the meantime, learned counsel appearing for the petitioner, Jammu
Municipal Corporation, is directed to provide a list of all similar cases so that
matters of different texture, pleadings and prayers are grouped and clubbed
with the instant petition in terms of order dated 03.02.2026 passed by this
Court. The said list shall be submitted before the Registry today. Upon
submission, the Registry shall list all the clubbed petitions along with the
instant matter on 25.03.2026 in the supplementary list.
