Learned advocate appearing for the petitioners
submits that the petitioner no.1 is the father-in-law;
petitioner no.2 is the mother-in-law and the petitioner no.3
is the sister-in-law of the deceased. The marriage was
solemnized in April, 2024. The husband was arrested in
connection with the instant case and charge-sheet has
already been submitted before the learned jurisdictional
court.
Learned advocate for the State opposes the prayer
for bail and draws the attention of the court to the

statement of the witnesses under Section 183 of the BNSS;
the postmortem report as well as the inquest report.
Learned advocate for the defacto-complainant
submits that within a close proximity of time, the deceased
was compelled to end her life.
I have taken into account the materials appearing in
the case diary including the postmortem report.
Having regard to the fact that the husband of the
deceased was taken into custody and charge-sheet has
already been submitted, I am of the opinion that custodian
detention of the present petitioners at this stage may not be
required.
Hence, the prayer for anticipatory bail of the
petitioners is Allowed.
Accordingly, I direct that in the event of arrest, the
petitioners [Biswajit Mondal, Mithurani Mondal and Riya
Mondal] be released on bail upon furnishing bond of
Rs.20,000/-(Rupees Twenty Thousand only) each, with two
sureties of Rs.10,000/- (Rupees Ten Thousand only) each,
one of whom must be local, to the satisfaction of the
arresting officer of the case and also subject to the
conditions as laid down under Section 438(2) of the Cr.P.C.
and/or under Section 482(2) of the Bharatiya Nagarik
Suraksha Sanhita, 2023.

As charge-sheet has already been submitted, this
order of anticipatory bail will remain in force for a period of
six weeks.
Accordingly, CRM (A) 1799 of 2026 is disposed of.
Memo of Evidence submitted be kept with the record.
Parties to act on a server copy of this order duly collected from
the official website of the Hon’ble High Court, Calcutta.
