    S.S. Mishra, J. The present Criminal Appeal, filed by the appellant is

    directed against the judgment and order dated 29.11.1997 passed by the

    learned Sessions Judge-cum-Special Judge, Sonepur, Balangir in

    Sessions Case No.29 of 1996, whereby the appellant was convicted for

    the offences punishable under Section 376 of the Indian Penal Code and
    Sections 3(1)(xi) and 3(1)(xii) of the Scheduled Castes and Scheduled

    Tribes (Prevention of Atrocities) Act, 1989 and sentenced to undergo

    rigorous imprisonment for seven years and to pay fine of Rs.3,000/-, in

    default to undergo rigorous imprisonment for one year for the offence

    under Section 376 IPC. The appellant was further sentenced to undergo

    rigorous imprisonment for three years on each count for the offences

    under the SC & ST (POA) Act. All the sentences were directed to run

    concurrently.
