    01. 1. Heard Mr. B.S. Das, learned counsel appearing for the
    appellant and Mr. Jateswar Nayak, learned Additional
    Government Advocate appearing for the respondent-State.

    2. This criminal appeal has been filed by the convicted
    accused-appellant against the judgment and order of
    conviction dated 26th March, 2026, passed by the learned
    Sessions Judge, Sambalpur in S.T. No.26 of 2022, arising out
    of Katarbaga P.S. Case No.165 dated 17.09.2021. By the said
    judgment, the appellant has been convicted under Sections
    148
    , 302, 307 and 149 of the Indian Penal Code and
    sentenced (i) to undergo R.I. for a period of two years for the
    offence under Section 148 of the IPC, (ii) to undergo R.I. for

    a period of 10 years with a fine of Rs.10,000/- (rupees ten
    thousand), in default, to undergo R.I. for a period of one
    month for the offence under Sections 307 &149 of the IPC &

    (iii) to undergo rigorous imprisonment for life with a fine of
    Rs.10,000/- (rupees ten thousand), in default, to undergo
    rigorous imprisonment for a period of two months for the
    offence under Section 302 & 149 of IPC.

    3. Aggrieved by the said judgment and order of conviction
    dated 26th March, 2026, the appellant has preferred this
    statutory appeal under Section 374 of Cr.P.C., 1973
    equivalent to Section 415 of B.N.S.S., 2023.

    4. Admit this appeal.

    5. Call for the scanned copy of the Trial Court Records of
    S.T. No.26 of 2022, arising out of Katarbaga P.S. Case No.165
    of 2021 from the Court of the learned Sessions Judge,
    Sambalpur.

    02. 1. Heard learned counsel appearing for the parties.

    2. There shall be stay of realization of the fine imposed on
    the appellant-petitioner by the learned Sessions Judge,
    Sambalpur vide judgment dated 26th March, 2026 passed in
    S.T. No.26 of 2022, arising out of Katarbaga P.S. Case No.165
    of 2021, pending disposal of the appeal.

    3. The I.A. is accordingly disposed of.

    03. 1. This is an application for bail.

    2. Learned Counsel for the State shall apprise the Court on
    the next date of listing regarding the criminal antecedents of the
    convict-appellant as well as his conduct in jail.

    shall also obtain the scanned copy of the relevant Case Diary as
    well as the Custody Certificate of the appellant.
