1. The petitioner has preferred this bail application under
Section 483 of BNSS in FIR No.36/2006 registered at Police
Station Sadar, District Dholpur for offences under Sections 399,
402, 353 and 307 IPC, 1860, Sections 3/25 of Arms Act and
Sections 11 RDAA Act.
2. Heard learned counsel for the petitioner as well as learned
Public Prosecutor and perused the material available on record.
3. Learned counsel for the petitioner contends that the
petitioner has falsely been implicated in this case. He submits that
a standing arrest warrant was issued against the petitioner in
connection with FIR No. 36 of 2006, Police Station Sadar, Dholpur.
He further submits that the police had filed a charge-sheet under
Section 299 CrPC in the said FIR on 27.09.2011, and thereafter,

the petitioner surrendered before the learned trial Court on
17.04.2026. It is contended that the petitioner has no knowledge
of the pending FIR and is a local resident of the concerned area.
Petitioner is behind the bars since 17.04.2026 without any
criminal past. The trial of the case will take considerable time,
therefore, no fruitful purpose would be served by keeping the
petitioner in further custody, consequently, the bail application
deserves to be allowed.
