1. By this application filed under Section 12A of the Commercial Courts
Act, 2015, read with Section 151 of the Code of Civil Produce, 1908,
applicant is seeking dispensation of Pre-institution Mediation.

2. Applicant/plaintiff herein has instituted Commercial Suit, seeking, inter
alia, permanent injunction restraining infringement of trade marks,
passing off, trade dress infringement, copyright infringement, delivery-up,
rendition of accounts, damages, appointment of a Local Commissioner,
preservation of infringing material and other consequential reliefs against
the defendants, who have dishonestly adopted and are continuing to use
impugned mark “SUPER AGRO-TECH” together with deceptively
similar packaging and trade dress in relation to identical and allied
agricultural goods of the plaintiff.
