Heard the learned counsel Mr. S.C. Biswas appearing for the petitioner. Also
heard Mr. K. Baishya, the learned Addl. Public Prosecutor, Assam.
2. This application under Section 482 of the BNSS, 2023 has been filed by the
petitioner, namely- Bappan Dhar @ Bapan Dhar in connection with P.R. Case
No.2633/2024 (corresponding to Katigorah P.S. Case No.52/2024, under Sections

307/325/326 read with Section 34 of the Indian Penal Code) pending before the court
of learned Judicial Magistrate First Class No.2, Cachar, Silchar.
3. The learned counsel for the petitioner has submitted that in the aforesaid case,
charge sheet has been laid against the present petitioner under the aforementioned
penal provisions. He submits that initially summonses were issued against the
petitioner by the trial court. However, in spite of receiving summonses, he could not
appear before the trial court due to some personal difficulties. He submits that in the
meanwhile Non-Bailable Warrant of Arrest (N.B.W.A.) was issued against him and the
next date of his appearance has been fixed on 12.08.2026.
