Order

1. The present writ petition has been filed by the petitioner with
the following prayers:-
“(i) issue an appropriate writ, order or direction
quashing and setting aside the impugned
transfer order (Annexure-1) whereby the
petitioner has been transferred from
Government Upper Primary School, Khatri Farm,
Tinwari, District Jodhpur to Government Senior
Secondary School, Tawariwala, District Phalodi;
(ii) issue an appropriate writ, order or direction
directing the respondents to permit the
petitioner to continue to discharge his duties at(Uploaded on 18/07/2026 at 02:17:22 PM)

(iii) in the alternative, direct the respondents to
consider and accommodate the petitioner
against any available vacant post situated within
or around Tinwari/Mathania, including
Government Upper Primary School, Rajasni,
Government Upper Primary School, Mathania or
Government Upper Primary School, Shiv Nagar,
Ghevda, in accordance with administrative
requirements;
(iv) declare that the impugned transfer order,
having been passed without any discernible
administrative exigency and without considering
the petitioner’s humanitarian circumstances, is
arbitrary and violative of Articles 14 and 21 of
the Constitution of India;
(v) award costs of the present writ petition in
favour of the petitioner; and
(vi) pass any other appropriate writ, order or
direction which this Hon’ble Court may deem
just, proper and expedient in the facts and
circumstances of the case.”
2. The petitioner is present in person and submits that he has
been transferred from Government Upper Primary School, Khatri
Farm, Tinwari, District Jodhpur, to Government Senior Secondary
School, Tawariwala, District Phalodi, which is approximately 225
km from his present place of posting. He further submits that his
parents are about 90 years of age and that he is required to look
after them and attend to their medical needs.
3. Aforesaid contentions were opposed by learned AGC
appearing on behalf of the respondents and he submits that due
to administrative exigency the transfer has been effected but
considering the grievance as raised by the petitioner, the
petitioner is free to make a representation before the Grievance
Committee constituted vide office order dated 17.07.2026 for
resolving the issues pertaining to husband-wife serving in
government department/single women/widow/divorcee/
employees suffering grave illness and many other issues. He

submits that the petitioner can file his representation before the
Grievance Committee, which will consider the representation on
the grounds raised by the petitioner in an expeditious manner
and this petition can be disposed at this stage..

5. Taking into consideration the grievance raise herein and also
the fact that a Grievance Committee has been constituted vide
office order dated 17.07.2026, this Court deems it appropriate to
direct the petitioner to file his representation before the Grievance
Committee within a period of ‘2 days’ from today and the
Committee shall decide the representation within a period of ‘7
days’ thereafter, strictly in accordance with law by way of passing
a speaking order.
6. With the aforesaid directions, the writ petition is disposed of.
