1. The petitioner has assailed order passed by the learned revisional
court, whereby the discharge order was set aside and charge for offence
under Section 420/406/120B IPC was directed to be framed against the
present petitioner.
2. Broadly stated, the circumstances are that the present petitioner and
two more ladies floated a company and induced certain persons to invest in
the same, but ultimately, the money invested was not returned.
3. Today, learned counsel for petitioner mainly argued that since
husbands of the present petitioner and those two ladies were government
servants, the company was floated with the said three ladies as Directors, but
those ladies had no active role to play. It is argued today that there is no

evidence to show that the present petitioner induced anyone to invest or
receive money from anyone. It is contended that merely because the
petitioner was Director of the said company, she cannot be charged.
4. Learned APP for State took me through statements of eight witnesses
of prosecution, who have categorically alleged that the present petitioner and
her husband induced them to invest and cheated them. Those statements
form Annexure A-5 (colly).
5. At this stage of arguments, due to some connectivity issue at the end
of learned counsel for petitioner, his audio-video has failed.
6. For further arguments, list on 07.10.2026 in Advance List.
7. Copy of this order be sent to the learned trial court making it clear that
there is no stay on the trial court proceedings.
