ORDER
1] They are heard. Perused the case-diary.
2] This is the first application filed by the applicants Anil, Devkanyabai and Asha
under Section 482 of the Bhartiya Nagrik Suraksha Sanhita, 2023/Section 438 of
Criminal Procedure Code, 1973 for grant of anticipatory bail as they are apprehending
their arrest in connection with Crime No.44/2026 registered at Police Station Garoth,
District Mandsaur for the offence punishable under Sections 115(2), 126(2), 296(B),
351(3), 3(5), 308(6) and 61(2) of B.N.S., 2023.
3] The allegation against the applicants is of assault.
4] Counsel for the applicants has submitted that the complainant herein is a doctor,
Shyam Sethia, against whom earlier an offence at Crime No.499 of 2025 dated
19.12.2025 was registered for outraging the modesty of the sister-in-law of the
applicant No.1, and as a counterblast only the present FIR has been lodged on
31.01.2026, of which the date of incident is also stated to be 19.12.2025. Thus, it is
submitted that the custodial interrogation of the applicants in the present case would not
be necessary.
5] Counsel for the respondent/State has opposed the prayer.
6] Having considered the rival submissions and on perusal of the case diary, it is

found that in the FIR the complainant has also mentioned that the CCTV footage of the
incident is also available, which he would produce, but no such document is available
on record. In such circumstances, this Court is of the considered opinion that the
custodial interrogation of the applicants would not be necessary, especially when there
are no criminal antecedents against the applicants.
7] Accordingly, without commenting anything on the merits of the case, the
application is allowed. It is directed that in the event of arrest, applicants – Anil,
Devkanyabai and Asha shall be released on bail, upon their executing a personal bond
in the sum of Rs.25,000/- (rupees twenty five thousand only) each and furnishing
separate solvent surety in the like amount to the satisfaction of the Arresting Officer
(Investigating Officer). The applicants shall make themselves available for
interrogation by a Police Officer, as and when required. They shall further abide by the
other conditions enumerated in Sub Section (2) of Section 438 of the Code of Criminal
Procedure, 1973.
8] Accordingly, MCRC stands allowed.
