1. Today’s short date was taken specifically by the counsel for petitioner
but none appears on behalf of petitioner.
2. As such, the matter is passed over.

Mr. Sanjeev Sabharwal, APP for State (through

3. In this second call, petitioner has appeared in person and he submits
that lawyers are on strike, so his counsel has not appeared today. The
petitioner submits that he wants to address arguments personally.
4. I have heard the petitioner, Mr. Trilok Singh at length.

5. The present petitioner Mr. Trilok Singh is cousin of Late Mr. Amrik
Singh. It appears that both of them filed separate applications under Section
156(3) CrPC and the application filed by Mr. Amrik Singh was allowed but
the application filed by Mr. Trilok Singh was adjourned sine die in view of
the allowing of the other application. Against the order directing registration
of FIR on complaint of Mr. Amrik Singh, a revision petition was filed by the
State impleading Mr. Amrik Singh as a respondent. During pendency of that
revision petition, Mr. Amrik Singh passed away, so Mr. Trilok Singh filed
an application seeking substitution of Mr. Amrik Singh with him. That
application was dismissed by the Court of Sessions by way of the impugned
order. Prima facie, I am of the view that the said revision does not abate on
account of death of Mr. Amrik Singh. The legality, correctness and propriety
of the order which is assailed before the Court of Sessions has to be
examined by the learned Court of Sessions independently, because the
provision under Section 397 CrPC (Section 438 BNSS) also confers suo
motu powers on the Court of Sessions.
6. Against the above backdrop, Mr. Trilok Singh submits that the only
thing he wants is to be heard by the Court of Sessions. For that purpose, he
wants to withdraw this petition.
7. But since counsel for petitioner has opted not to appear even through
videoconferencing, it would be appropriate that Mr. Trilok Singh is allowed
an opportunity to consult his counsel first and thereafter, if so advised, he
may file an appropriate application.
8. Relist on 31.08.2026 in Advance List.
