01. The petitioner-Achyutanand Mishra was serving as

SPONSORED

Constable No. 064444206 in Border Security Force (BSF).

02. The petitioner came to be implicated in FIR No. 05/2018

registered by the Anti-Terror Squad (ATS) of Uttar Pradesh (U.P.) for

an alleged commission of offences under sections 419/

420/121/121-A of the Indian Penal Code (IPC), under section 66 D

of Information Technology Act, 2000 and under sections 3, 4, 5 & 9

of the Official Secrets Act, 1923 which resulted in the filing of a

charge-sheet under the Official Secrets Act, 1923 with the petitioner

being arrayed as the sole accused. Trial of the criminal case against

the petitioner is still going on but in the meantime the petitioner

came to suffer proceedings under the Border Security Force (BSF)

Act, 1968 which resulted in his dismissal with effect from

02.06.2025 by an order No. Estt/128/120Bn/2025/21863-85

dated 02.06.2025 passed by the Commandant 120 BN BSF against

which the petitioner’s statutory remedy also resulted in dismissal by

order No. dzekad% 4606@LFkk0 ¼prqFkZ½@lhekUr tEew@lhlqo@2025@1280&85

fnukad% 13 Qjojh 2026 by the order of the Inspector General, BSF

Jammu Frontier which has now brought the petitioner in the

present writ petition to assail his termination terming it as null and

void on the basis of the grounds as pleaded in para 7.

03. Admit for hearing.

04. Issue post-admission notice to the respondents in the

main petition as well in application-CM-No. 2381/2026.

05. Notice waived by Mr. Vishal Sharma, learned DSGI

assisted by Mr. Eishaan Dadhichi, learned CGSC on behalf of the

respondents.

06. Counter affidavit to the writ petition be filed within a

period of four weeks along with reply to the CM No. 2381/2026.
