Rs.3,93,215/- with interest at 9% p.a. and further
damages of Rs.50,000/- with interest at 9% p.a. from the
date suit till realization.
2. The case of the plaintiff in brief is as under:-
The plaintiff is engaged in the business of exclusively
trading with welding consumables manufactured by
KISWEL LTD., a Korean Multinational Conglomerate and
Superon Technik India Pvt. Ltd., The defendant is into the
business of manufacturing wide range of transformer
radiators, shells and allied accessories. The defendant was
purchasing the welding consumables, manufactured by
the above said companies from the plaintiff for the last 15
years and has been regular purchaser of the welding
consumables. The defendant had issued 4 purchase
orders to the plaintiff seeking for supply of the welding
consumables totally valued at Rs.36,91,448/- under the
following purchase orders:
