% 02.05.2026
1. Petitioners seek quashing of case FIR No. 01/2021 of PS New Ashok
Nagar for offence under Section 498A/406/34 IPC on the ground that the
complainant de facto (respondent no.2 herein) has settled all matrimonial
disputes with the petitioners.
2. The matter was listed today at a short date specifically at the request
of learned counsel for petitioners, but he has not appeared. It is stated by
petitioners that lawyers are on strike.
3. Strike by lawyers is no ground to adjourn a matter. As such, I have
examined the issue.

4. In the FIR, it is alleged by the present respondent no. 2 that her father-
in-law (petitioner no. 2 herein) took along her brother and after digging soil
under a tree showed him bombs and guns and told him that they make
people invisible in a day; and that her brother got scared and cried and told
her the entire incident.
5. The IO/ASI Anand Kumar from PS New Ashok Nagar submits that
he had investigated the above aspect of possession of arms and ammunition,
but did not find any such material. But on being called upon to show any
statement or Case Diary or any other material reflecting that he has
investigated such serious charge, the IO is unable to show the same. On this
aspect, a specific status report be filed by the concerned DCP within four
weeks.
