1. This criminal appeal, under Section 374 (2) Code of Criminal Procedure, 1973, (in short Cr.P.C.), has been filed by appellant, Baleshwar Prasad, against the judgment and order dated 02.05.1985, passed by Sri Lokmani Dongrakoti, the then Ist Additional Sessions Judge, Saharanpur, in Sessions Trial No. 317 of 1983 (State v. Baleshwar Prasad and another), under Sections 18 (a) (i) (ii) (iia), read with Sections 17 (e) (f) and 17-(b) (e) (ii) punishable under Section 27 (a) of the Drugs and Cosmetics, Act 1940, and Section 5 of the Prevention of Adulteration of Food, Drugs and Cosmetics (U.P. Amendment) Act 1974, Police Station Jwalapur, District Saharanpur.

By the impugned judgment and order, the learned Trial Court acquitted co-accused Som Prakash Verma and convicted the appellant for offence punishable under Sections 18 (a) (i) (ii) (iia) read with Sections 17 (e) & (f) and 17-(b) (e) (ii) punishable with Section 27 (a) of the Drugs and Cosmetics, Act 1940 and Section 5 of the Prevention of Adulteration of Food, Drugs and Cosmetic (U.P. Amendment) Act 1974 and sentenced him to undergo three years rigorous imprisonment.
