MFA No.101762/2015 is filed under Section 173(1) of
the Motor Vehicles Act, 1988, (for short, ‘M.V. Act’) by the
insurer challenging the judgment and award dated
15.04.2015 in MVC No.2109/2013 on the file of IV
Additional District & Sessions Judge & Member MACT-V,
Belagavi in saddling the liability on insurer in the absence
of D.L. and challenged the involvement of the offending
vehicle and MFA.CROB.No.101762/2015 is filed by the
claimant for enhancement dissatisfied by the
compensation awarded in said case.
2. Parties would be referred with their ranks as
they were before the Tribunal for the sake of convenience
and clarity.
3. The facts narrated before the Tribunal by the
claimant is that when claimant was playing in front of his
house on 05.09.2013 at about 12.00 noon on Kali Ambrayi
Rex Talkies main road, Belagavi, a motorcycle bearing
registration No.KA-22/EH-7729 came from Kali Ambrayi

Rex Talkies main road towards Maratha School and dashed
against the claimant and thereby caused the accident. Due
to the accident, claimant sustained grievous injuries and
he has taken treatment in the hospital and thus, claimed
compensation under several heads.
