    1. Leave granted.

    2. The appellants, namely, Ravi Malha @
    Monti and Ramesh Malha @ Gabbar, who are
    brothers, are aggrieved by the denial of
    regular bail by the High Court of
    Chhattisgarh at Bilaspur, vide order
    dated 02.04.2026 passed in MCRC No.
    2330/2026. They seek bail in relation to
    Crime/First Information Report (FIR) No.
    184/2024 dated 03.06.2024 registered with
    Police Station – Simga, District – Baloda
    Bazar-Bhatapara, for the offences
    punishable under Sections 302, 307, 427,

    294, 506, 323, 147, 149, 452, 458, 459

    and 460 of the Indian Penal Code, 1860.

    3. The appellants were arrested on
    24.06.2025 and they have been in custody
    since then. They were not named initially
    in the FIR and it is only by way of a
    supplementary charge sheet that they were
    implicated. However, even as on date, no
    specific case or allegation have been set
    up against them.

    4. It is for the prosecution to discharge
    its burden in this regard, but as on date
    we find no grounds made out for continued
    incarceration of the appellants, Ravi
    Malha @ Monti and Ramesh Malha @ Gabbar,
    pending completion of the trial.

    5. Accordingly, we accept the present appeal
    and direct that the appellants, Ravi
    Malha @ Monti and Ramesh Malha @ Gabbar,
    shall be released on bail in connection
    with the aforestated FIR on such
    appropriate terms and conditions as may
    be fixed by the Trial Court.

    6. In addition, the appellants, Ravi Malha @
    Monti and Ramesh Malha @ Gabbar, shall

    cooperate during the course of the trial
    and shall not delay the proceedings
    therein.

    7. The impugned order is set aside and the
    appeal is allowed in the aforestated
    terms.

    8. We clarify that we have not made any
    observations/comments on the merits of
    the case and any observation made in this
    order is meant only for the limited
    purpose of grant of bail.

    9. Pending application(s), if any, shall
    stand disposed of.

    In terms of the signed order, it is directed

    that the appellants, Ravi Malha @ Monti and Ramesh

    Malha @ Gabbar, shall be released on bail in

    connection with Crime/First Information Report

    (FIR) No. 184/2024 dated 03.06.2024 registered

    with Police Station – Simga, District – Baloda

    Bazar-Bhatapara, for the offences punishable under

    Sections 302, 307, 427, 294, 506, 323, 147, 149,

    452, 458, 459 and 460 of the Indian Penal Code,

    1860, on such appropriate terms and conditions as

    may be fixed by the Trial Court.

    The appeal is allowed in terms of the signed

    order.

    disposed of.

    The State of Chhattisgarh states that it

    filed its counter affidavit on 11.07.2026.
