Present Mr. S. Rupachandra, learned senior counsel assisted by
Mr. Royal Ray Salam, learned counsel for the appellants.
At the outset, Mr. S. Rupachandra, learned senior counsel for the
appellants, submits this Court that when I (Mr. Justice A. Guneshwar
Sharma) was a District Judge, Imphal West, Judl. Misc. Case No. 62 of 2021
and Judl. Misc. Case No. 78 of 2021 in RFA No. 26 of 2016/06 of 2019, vide
common order dated 12-05-2022, were disposed of. In Judl. Misc. Case No.
78 of 2021, the prayer for the appellants herein (before District Court also)
for filing additional documents was rejected. The order dated 12-05-2022
passed by the District Judge, Imphal West in Judl. Misc. Case No. 78 of
2021 is challenged by the appellants herein before this Court by way of
CRP(C.R.P. Art. 227) No. 33 of 2022 and the civil revision petition is still
pending before this Court. Mr. S. Rupachandra, learned senior counsel for
the appellants, submits that the present regular second appeal arises out of

the final judgment and decree dated 21-02-2026 passed by the incumbent
District Judge, Imphal West in RFA No. 26 of 2016/06 of 2019. It is submitted
that since civil revision petition arising out of Judl. Misc. Case No. 78 of 2021
is pending before this Court, it may not be appropriate for me to hear the
present appeal arising out of the first appeal.
This Court has perused the material on record and is of the view that
due to pendency of civil revision petition arising out of misc. case in the first
appeal (impugned herein) preferred by the appellants herein before this
Court, the matter may be listed before appropriate Bench.
Registry is directed to place the matter before Hon’ble the Chief
Justice on administrative side for placing before appropriate Bench.
