the Narcotic Drugs and Psychotropic Substances Act, 1985 (for
short ‘NDPS Act‘).
2. Heard Mr. Kodari Mallikarjuna, learned counsel for the
petitioner and Mr. Vivekananda Reddy, learned Assistant Public
Prosecutor appearing for the respondent-State.
3. Learned counsel for the petitioner submitted that the
petitioner is innocent and has been falsely implicated in the case.
The petitioner was apprehended and remanded to judicial custody
on 22.12.2025 and he is not having any criminal antecedents.
Hence, learned counsel prayed this Court to enlarge the petitioner
on bail.
4. On the other hand, learned Assistant Public Prosecutor
opposed for grant of bail stating that the allegations leveled
against the petitioner are serious in nature as the seized
contraband is commercial quantity. Further, the investigation is
not yet completed. Hence, he prayed the Court to dismiss the
criminal petition.

5. In the light of the submissions made by both the learned
counsel and a perusal of the material available on record, it
appears that the contraband seized 12 grams of MDMA and 8.06
grams of OG Kush, which is a commercial quantity. Further, in
view of rigour of Section 37 of NDPS Act, the petitioner is not
entitled for the bail. Hence, this Court is not inclined to grant bail
to the petitioner and the same is liable to be dismissed.
6. Accordingly, the Criminal Petition is dismissed.
Miscellaneous applications, if any pending, shall stand
closed.
