C A V Order

1. This Writ Petition has been filed by the petitioner against various inaction

on the part of respondent authorities with respect to the service benefits of

the petitioner. Petitioner claims that respondent authorities have not

granted petitioner pro-forma promotion from the date of promotion, accrued

in favour of petitioner in view of the similarly situated persons. The

Petitioner is also aggrieved that he has not been granted interest of @ 18%

compound interest (compounded quarterly) on delayed payment of dues of

leave encashment, gratuity, arrears of pay and arrears of pension and

amount of arrears of above claims after revision of pay fixation order. The

Petitioner is seeking compensation to the tune of Rs One crore, as penalty

for malicious prosecution by the agencies of the State Government in

falsely prosecuting him in corruption case. The petitioner is also seeking

payment of double amount of all claims paid to the petitioner i.e. leave

encashment, gratuity, arrears of pay, arrears of pension, regular pension

and amount of arrears of above claims after revision in pay fixation.
