                   JUDGMENT AND ORDER (ORAL)

1. This is an application seeking modification, alteration of the order

dated 27-03-2026, passed in WP(C). No. 143 of 2026.

2. Mr. R.Kharsyad, learned counsel for the applicant submits that the

only limited prayer in the misc. application for modification is for directions

for convening a Dorbar meeting of Urksew-Wahpathaw village, East Khasi

Hills. Learned counsel submits that this stalemate has occurred due to the

order of the KHADC, whereby instead of issuing directions for convening a

Dorbar, have also added therein that the said Dorbar shall elect the

Headman. He submits that at this stage, what is necessary is only for a

Dorbar to be convened to discuss the village affairs.

3. Ms. A.Kharshiing, learned counsel for the respondent No. 4, who has

preferred the earlier petition against the said order of the KHADC, has no

objection to the prayer of the applicant being allowed but however, she

submits that as per the order dated 11-11-2025, the meeting will be convened

under the supervision of an observer to be deputed by the office of the Syiem

of Khyrim as also the District Council.

4. On hearing the learned counsel for the parties, as it is seen that there

is a consensus with regard to holding of a Dorbar and for elections to be set

at a later date, this misc. application is allowed. However, it is made clear

that the directions contained in the order dated 11-11-2025, shall also be

followed by the parties in convening the Dorbar.

5. As ordered above, the instant misc. application is allowed and stands

disposed of.
