Challenge in this writ petition is to the coercive recovery
action initiated under the provisions of the SARFAESI Act,
2002
.

2. Learned counsel for the Petitioner, Ms. Ray, fervently
submits that her client had availed a loan of ₹30,00,000/-
(Rupees Thirty Lakhs only) on 13.08.2022 and another sum of
₹10,00,000/- (Rupees Ten Lakhs only) on 20.03.2023 along
with an additional amount of ₹78,900/- (Rupees Seventy-Eight
Thousand Nine Hundred only) on the same day. She submits
that only a sum of ₹2.25 lakhs remains outstanding and due to
financial difficulties the Petitioner could not make the
remittance in time.

She draws our attention to the auction notice dated
28.02.2026 (Annexure-4), whereby the secured asset is
scheduled to be put to auction today. It is submitted that if such
auction is allowed to proceed, the Petitioner would suffer
irreparable prejudice, particularly when he is ready and willing

to liquidate the outstanding dues, which according to him is a
small amount.

3. Having heard learned counsel for the parties and upon
perusal of the petition along with I.A. No.6271 of 2026
supported by affidavit, we are of the considered view that the
scheduled auction deserves to be deferred till the next date of
hearing, subject to the Petitioner depositing a sum of ₹13.5
(Rupees Thirteen lakhs and Fifty Thousand only) with the
Opposite Party-Bank before 3:00 PM today.

Failing such deposit, not only shall this interim protection
stand vacated automatically, but the writ petition shall also run
the risk of dismissal on that ground itself.
