                      JUDGMENT AND ORDER (ORAL)

    1. This is an application under section 24(5) of the CPC for transfer of

    Title Suit No. 47 of 2024, from the Court of Shri. A.E.Gatphoh, Subordinate

    SPONSORED

    District Council Court, Shillong, to the Court of the Assistant to Deputy

    Commissioner, East Khasi Hills, Shillong.

    2. The petitioner in person, has submitted that the transfer is sought in

    view of the fact that the matters which are substantial in issue in the suit

    sought to be transferred are also in issue in the Court of the Assistant to

    Deputy Commissioner, Shri. D.K.K.Mihsill, in Title Suit No. 8 of 2025 and

    Title Suit No. 16 of 2024. She submits that for ease of adjudication, the

    transfer has been sought.

    3. Ms. S.K.Nongrum, learned counsel for the respondent No. 2, who is

    the defendant in Title Suit. No. 47 of 2024, has no objections to the said

    transfer.

    4. Mr. B.A.Wanswett, learned counsel for the respondent No. 3, who is

    also a party in the proceedings also has no objections.

    5. Accordingly, the prayer of the petitioner in person is allowed and Title

    Suit. No. 47 of 2024, pending in the Court of Shri. A.E.Gatphoh,

    Subordinate District Council Court, Shillong, shall stand transferred to the

    Court of Shri. D.K.K. Mihsill, Assistant to Deputy Commissioner, Shillong,

    to be tagged together with Title Suit. No. 8 of 2025 and Title Suit No. 16 of

    2024, pending before that Court.

    6. With regard to the other prayer made by the petitioner in person, the

    same is not considered by this Court as the relief prayed for should be made

    before the Trial Court itself.

    7. As ordered above, matter stands closed and disposed of.
