    1. The petitioner claims to be a member of a Cooperative Housing Building

    SPONSORED

    Society, namely, Sainik Colony, Jammu. According to him, he acquired shop site

    No. AS 90 situated in Sector No. A Sainik Colony, Jammu from Ex. Capt.

    Somant Singh Sambyal, which was subsequently leased out to the petitioner in

    terms of perpetual lease deed dated 07.08.2012.

    2. It is the case of the petitioner that the petitioner approached respondent No.

    4 for issuance of No Objection Certificate, which is a prerequisite for raising

    construction within the jurisdiction of Jammu Municipal Corporation. However,

    the request has been denied on the ground that the shop site No. AS-90 had earlier

    been allotted to Lt. Col. Puran Singh Sambyal and registered in his name on

    13.02.1993. It has further been stated that the same shop site, bearing registration

    No. 6861, was also earmarked in favour of Ex. Sgt. Ramesh Chander Bayotra,

    thereafter transferred to Ex. Capt. Somant Singh Sambyal on 18.05.2009 and

    2026:JKLHC-JMU:2378

    ultimately transferred to petitioner on 07.08.2012. It appears that the same site has

    been allotted to the Puran Singh Sambyal as well as to the petitioner.
