The Supreme Court, in Prabhakar Yeshwant Masram & Anr. v. Sou Tula Namdeorao Jaipurkar & Anr. (2026 INSC 724), delivered an important judgment clarifying the distinction between a “wrong statement” and a “false statement” in legal pleadings. The Court held that merely because a pleading contains an incorrect or erroneous statement does not automatically amount to giving false evidence or making a false declaration so as to attract prosecution for perjury.
The decision is significant as it clarifies that proceedings under Section 340 CrPC (now Section 379 BNSS) cannot be invoked for every incorrect pleading. The Supreme Court reaffirmed that only deliberate falsehoods, not innocent mistakes, justify prosecution for perjury.
