    The present bail application has been preferred by the

    petitioner under Section 483 of BNSS (Old Section 439 Cr.P.C.) in

    connection with FIR No.341/2025 registered at Police Station

    Deogarh, District Rajsamand for the offences punishable under

    Section 115(2), 126(2), 189(2), 103(2) & 109(1) and Sections

    4/25 of the Arms Act, 2019.

    2. Heard learned counsel for the petitioner and learned Public

    Prosecutor. Perused the material available on record.

    3. Learned counsel for the petitioner submitted that the

    petitioner has falsely been implicated in the matter as name of the

    petitioner is not mentioned in the FIR. He further submits that the

    specific allegation of causing fatal injuries to injured Maan Singh

    and others with the sharp weapon are either attributed to other

    co-accused Sunil @ Surendra or Rajendra Kumar. The cause of

    death of deceased Maan Singh is due to hemorrhagic shock and

    stab wound injuries at his chest and abdomen. It is further

    submitted that co-accused Mithu Singh S/o Hari Singh Rawat has

    already been enlarged on bail by the co-ordinate Bench of this

    Court while deciding S.B. Criminal Misc. Bail Application

    No.1874/2026 vide order dated 05.03.2026. Learned counsel

    submitted that the petitioner is in judicial custody and the trial of

    the case will take sufficiently long time, therefore, the benefit of

    bail may be granted to the accused-petitioner.

    4. Per contra, learned Public Prosecutor has vehemently

    opposed the bail application and contended that the petitioner and

    other co-accused assaulted injured Maan Singh and caused as

    many as nine injuries which resulted into his death. It is also

    contended that the other injured also received stab wound

    injuries. The witnesses Prahlad Singh in his statement rendered

    under section 180 of BNSS has specifically stated that the

    petitioner along with the other co-accused assaulted Maan Singh

    and the other injured, therefore, considering the aforesaid facts,

    the bail application of the accused-petitioner may be dismissed.

    5. Deceased Maan Singh died due to hemorrhagic shock, as a

    result of injuries sustained at his abdomen and chest, the injuries

    are specifically attributed to other co-accused and not to the

    present petitioner. The other injured also sustained stab wound

    injuries which are also not attributed to the present petitioner,

    rather attributed to the other co-accused namely Sunil @

    Surendra, therefore, without further expressing anything on the

    merits of the case, I deem it just and proper to enlarge the

    accused-petitioner on bail.

    6. Consequently, the bail application under Section 483 of BNSS

    (Old Section 439 Cr.P.C.) is allowed. It is ordered that the

    accused-petitioner Gajendra Singh S/o Sohan Singh Rawat,

    arrested in connection with FIR No.341/2025 registered at Police

    Station Deogarh, District Rajsamand shall be released on bail

    provided he furnishes a personal bond of Rs.50,000/- and two

    sureties of Rs.25,000/- each, to the satisfaction of learned trial

    Court, for his appearance before that Court on each & every date

    of hearing and whenever called upon to do so till completion of the

    trial.
