Judgment
11/05/2026
1. Since the controversy involved in all these writ petitions
is identical and reliefs prayed by the petitioners are also one and
same, therefore, they were heard analogously and are being
decided by this common judgment. S.B. Civil Contempt Petition
No. 92/2026 has also been filed by the petitioners in S.B. Civil
Writ Petition No. 11710/2025 alleging deliberate and willful
disobedience of interim order passed by this Court in that writ
petition, which is also tagged with this batch of petitions. However,
for the sake of convenience, the facts mentioned in S.B. Civil Writ
Petition No. 13045/2025 are being taken as lead case.
2. Learned counsel for the petitioners submitted that the
respondent-Rajasthan Staff Selection Board issued an
advertisement on 16.12.2022 inviting applications from eligible
candidates for recruitment on 27000 posts of Teacher Grade III
Level II in different subjects. The petitioners being eligible, applied
for the aforesaid posts in their respective categories. Thereafter,
the petitioners appeared in written examination and provisional
answer key of the written examination was released by the
respondents in the month of May, 2023. Thereafter, certain
objections were raised by several candidates on some of the
questions. However, final result was declared by the respondents
on 18.09.2023, but the petitioners could not secure their place in
their respective category.
3. It is further submitted that since some of the answers
to the questions published in the final answer key were factually

incorrect as per the authenticated textbooks available on the
respective subject, therefore, some of the candidates approached
Principal Seat of this Court at Jodhpur by way of filing S.B. Civil
Writ Petition No. 10309/2023 (Raman Choudhary vs. The
Chairman of Rajasthan Staff Selection Board & Another)
and other writ petitions on the subject matter. The writ
petitions were disposed of by Co-ordinate Bench of this Court at
Principal Seat, Jodhpur vide order dated 05.10.2023 directing the
respondents therein to refer the questions disputed in those writ
petitions to an expert committee to be constituted by the
respondents.
4. Learned counsel for the petitioners further urged that in
pursuance of aforesaid directions, an expert committee was
constituted by the respondent-Selection Board which examined
the disputed questions and in consequence thereof, revised result
dated 27.01.2025 was issued by the respondents. Thereafter, final
result was also issued by the respondents on 20.06.2025. It is
argued that the effect of revised and final result was that the
petitioners and many other candidates, who secured more marks
than the already appointed candidates pursuant to original result
in their respective categories, are being deprived of the benefit of
appointment on the post of Teacher Grade-III, Level-II in
respective subjects.
5. Learned counsel for the petitioners submitted that the
petitioners have secured more marks in their respective categories
and many lesser meritorious candidates than the petitioners are
still working on the posts of Teacher Grade-III, Level-II. Thus, the
petitioners, being more meritorious, are deprived of their

legitimate and fundamental right of being appointed on the post of
Teacher Grade III, Level-II in respective subjects. In support of
their arguments, learned counsel for the petitioners relied upon
decision of Co-ordinate Bench of this Court at Principal Seat,
Jodhpur in the case of Mukesh Kumar Tailor vs. State of
Rajasthan & Others (S.B. Civil Writ Petition No. 750/2017 &
other connected writ petitions decided on 09.02.2017) as
also decision rendered by Division Bench of this Court in the case
of Namonarayan Sharma & Others vs. The State of
Rajasthan & Others (D.B. Special Writ No. 908/2017 &
other connected appeals decided on 08.01.2020).
6. Per contra, learned Additional Advocate General
assisted by learned Additional Government Counsel opposed the
writ petitions and submitted that the petitioners have no vested
right to appointment merely on the ground that they could not
secure more marks than the cut off marks in revised result. The
entire selection process has been concluded and appointments
have already been made pursuant to original result dated
18.09.2023 as well as revised result dated 20.06.2025. The
petitioners are wrongly attempting to draw a comparison between
two separate selection phases based on different criteria and
timelines. Therefore, the petitioners cannot claim any right to
displace the already appointed candidates who have already
joined and working on their respective posts.
7. As regards grievance raised by the petitioners in
respect of appointments of less meritorious candidates than the
petitioners, learned Additional Advocate General urged that in the
revised result issued by the Rajasthan Staff Selection Board, 1301

candidates who had earlier been selected in the main list and
waiting list were removed from selection list. However, matter of
disputed questions was also under consideration before another
Co-ordinate Bench of this Court in Krishma & Others vs. The
Director, Primary Education, Bikaner & Others (S.B. Civil
Writ Petition No. 18767/2023 & other connected writ
petitions) which were disposed off vide order dated 28.11.2023
in the light of decision in the case of Raman Choudhary
(supra). However, while disposing off the aforesaid writ petitions,
the Co-ordinate Bench of this Court directed the respondents
therein to make a mention in the appointment orders of the
already selected candidates that in case, they do not find place in
the revised merit list, the appointments given to them before
revised result will not create any right in their favour to continue.
However, the candidates, who were affected by the above
direction, challenged that part of the judgment before Division
Bench of this Court by way of filing D.B. Special Appeal Writ
No. 612/2024 (Swati Bhatt & Others vs. The Director,
Primary Education, Rajasthan, Bikaner & Others) and other
connected appeals. The said appeals were allowed by the
Division Bench of this Court vide judgment dated 19.08.2025 and
appointment of those affected candidates were protected. Learned
Additional Advocate General, therefore, submitted that in case,
this Court is inclined to grant relief to the petitioners, then the
candidates, who have already been granted appointments, may
also be protected in the same manner in which the petitioners in
the case of Swati Bhatt & Others (supra) were protected by
the Division Bench of this Court.

8. I have heard learned counsel for the parties and
carefully perused the material on record including the decisions
cited at the bar.
9. The core question which arises for consideration by this
Court in the batch of instant writ petitions is that whether
petitioners, who, on the basis of revised result, have secured more
marks than the already selected and appointed candidates, are
entitled for the relief of appointments on the posts in question and
if yes, then in that event, to what treatment, the already selected
and appointed candidates are entitled to?
10. Somewhat similar and identical controversy arose
before Co-ordinate Bench of this Court at Principal Seat, Jodhpur
in the case of Mukesh Kumar Tailor vs. State of Rajasthan &
Others (S.B. Civil Writ Petition No. 750/2017 & other
connected writ petitions). In that case, concerned Zila Parishad
issued an advertisement for filling up posts of Teacher Grade III.
The result in that recruitment was revised and the petitioners in
that case stood as more meritorious than the earlier selected and
appointed candidates in the first list. Thus, a situation emerged in
that case where the candidates who had secured less marks than
the petitioners therein were still continuing in service. In such
factual backdrop, the Co-ordinate Bench of this Court vide order
dated 09.02.2017, disposed off the writ petitions in following
manner:
“a. The respondent-State shall workout the vacancies in
each of the Zila Parishads as expeditiously as possible.
Thereafter, the list shall be prepared of the candidates who
have got more marks than the last candidate still working
with the department in pursuance to the directions of this
Court passed in Manju Choudhary’s case (supra).
b. Thereafter, the candidates as per the ratio of 1:2 of the
vacancies available shall be called for the verification of the(Uploaded on 15/05/2026 at 03:25:16 PM)

eligible candidates as per their merit equivalent to the
vacancies available with the department.
c. This Court is aware that some of the candidates are
bound to be left out even though they have got more marks
than the last candidate but taking into account the limited
number of vacancies, the said candidates shall have to try
their luck in the next recruitment process afresh.
d. The said process be completed as expeditiously as
possible preferably within 06 months from today.”
11. However, some of the candidates approached this Court
by way of filing S.B. Civil Writ Petition No. 2329/2017 (Babu
Lal Meena vs. State of Rajasthan & Another) and other
connected writ petitions, which were disposed of by Co-ordinate
Bench of this Court vide order dated 20.02.2017 in the light of
decision in the case of Mukesh Kumar Tailor (supra) and Paras
Ram Bairwa vs. State of Rajasthan & Another (S.B. Civil
Writ Petition No. 2194/2017 decided on 17.02.2017). Even
after the order passed by this Court, when the appointments were
not made on the pretext of the interpretation of the words
“vacancies available”, D.B. Special Appeal Writ No. 908/2017
(Namonarayan Sharma & Others vs. The State of Rajasthan
& Others) and other special appeals came to be filed before
Division Bench of this Court. At this stage, it is pertinent to
mention that in the above batch of appeals, appellant
Namonarayan Sharma was one of the petitioners in batch of writ
petitions in the case of Babu Lal Meena (supra). The aforesaid
appeals were disposed of by Division Bench of this Court vide
judgment dated 08.01.2020 in the following manner:
“Accordingly, these appeals as well as all the applications
moved by the intervenors stand disposed of directing the
respondents to work out as to how many posts out of 41000
notified for the year 2012 recruitment remain unfilled as of
today on account of the fact that the candidates who were
offered appointment did not join or after joining resigned or
left the service and all of them would be treated as vacant
posts. Thereafter, the mandamus issued by the learned(Uploaded on 15/05/2026 at 03:25:16 PM)

[2026:RJ-JP:19914] (73 of 80) [CW-13045/2025]Single Judge in Umesh Singhal’s case shall be complied with.
The entire exercise shall be completed within eight weeks
from today by the respondents.”
(emphasis supplied)
12. Being dissatisfied by the above directions, the State
Government approached the Hon’ble Supreme Court by way of
filing civil appeals, leading one being The State of Rajasthan &
Others vs. Namonarayan Sharma & Others (Civil Appeal arising
out of SLP (C) No. 13102-13109 of 2020). The Hon’ble Supreme
Court vide its order dated 28.01.2026 disposed of the appeals in
the following manner:
“16. After hearing learned counsel for the parties at length
and on perusal of the stand as taken by the State
Government in the case of Mukesh Kumar Tailor (supra)
and batch (supra), it is clear from the averments referred in
the order dated 09.02.2017 that the judgment was based on
the concession of the State Government, which has not been
either recalled or assailed before any higher forum. On the
contrary, the Government has taken a decision on
04.09.2017 to implement the said order. In such
circumstances the respondents and the
impleaders/interveners, if they are similarly placed, cannot
be denied the benefit as allowed by the leaned Single Judge
and the Division Bench of the High Court by the order
impugned.
17. The respondents have also filed the counter affidavit
after the order dated 28.10.2025 passed in the proceedings
of this case. On perusal of the same, it is clear that in the
State of Rajasthan, at various Zila Panchayat levels,
approximately 7,500 vacancies are available for which an
advertisement has been issued and the examinations had
been held on 17.01.2026. In the circumstances, the
availability of the vacancies is not in dispute. Therefore, the
respondents as well as the impleaders/interveners, if they
fall between the candidate who is last appointed in
furtherance to the first selection list and below to the last
candidate of the revised selection list dated 02.09.2013
found, deserves appointment similar to the other persons
who have been appointed in the case of Mukesh Kumar
Tailor (supra) and batch and alike extending similar
benefit to them.
18. Also, at this juncture, it is not out of place to mention
that after passing of the impugned judgment by the High
Court, the State Government vide Minutes of Meeting dated
13.01.2020 has decided that to put a quietus to litigation in
furtherance to the recruitment of the advertisement dated
24.02.2012, the cases which are decided or pending before
the High Court may be taken up and no further cases of the
applicants be extended benefit at par. In view of the
foregoing, we are inclined to dismiss the present appeals
and reaffirm the directions as issued by the High Court in
the case of Mukesh Kumar Tailor (supra) vide the order

under challenge. Since the matter is pending from 2020,
therefore, to carry out those directions and for clarity, these
appeals stand disposed of in the following terms:
(i) A fresh list be prepared of the candidates who are
respondents/intervenors/impleaders before this Court from
the list of candidates last appointed in furtherance to the
first selection list dated 27.08.2012 and who fall below the
cut-off of the revised selection list dated 02.09.2013, within
a period of two months from the date of communication of
this order.
(ii) After preparation of such list on verification of
antecedents and other documents, the appointments be
made within two months.
(iii) We make it clear that the respondents or the
impleaders/interveners would be treated at par to the other
similarly situated persons, but the benefit of salary be
extended from the date of their joining. We also clarify that
on such appointment, they would be entitled to all
consequential benefits notionally.
(iv) Since the appointment has to be made at District level
on the vacancies so available, as such, in case the vacancy
in any subject is not available in that District, the
appointment of such candidate be offered for the nearby
district by the authorities taking recourse as permissible.
(v) After perusal of the judgments of Ramdhan Kumawat
(supra), Manju Chaudhary (supra), Rajesh Choudhary
(supra) and Mukesh Kumar Tailor (supra), one more
clarity is required regarding maintaining the inter-se
seniority of the Teachers. Otherwise, it will give rise to
another round of litigation. In the facts and circumstances of
the case, the inter-se seniority would be maintained in
terms of the merit of the revised seniority list and the people
who would be placed according to their merit in bottom
thereto including the respondents, wherever the candidate
find place their inter se seniority be maintained accordingly
by the State. We make it clear that this order of inter se
seniority has been passed by this Court with an intent to
curtail the anticipated litigation. However, the State
Government is at liberty to afford an opportunity, if
necessary, while determining such inter se seniority.
19. This decision is in the peculiar facts relying the
concessions of the State Government in the case of Mukesh
Kumar Tailor (supra), therefore, it would be confined to
the respondents and the impleaders/intervenors who have
approached this Court on or before this order. No further
avenue would remain open to any of the candidate.
20. Accordingly, the Civil Appeals are disposed of. Pending
applications, if any, shall also stand disposed of.”
13. In the light of above decisions of this Court as also
observations made by the Hon’ble Supreme Court in the case of
The State of Rajasthan & Others vs. Namonarayan Sharma

& Others (supra), this Court is of the considered view that the
petitioners, being meritorious, are entitled for the relief of
appointment on the post of Teacher Grade III, Level II.
14. The instant writ petitions were listed before the Court
on 07.04.2026 and the respondents were directed to file specific
affidavit stating therein total vacancies as advertised, total
number of persons as appointed prior to revision of the result,
remaining vacancies available on which the appointments were
made after revision of the result and as to what stand has been
taken by the State for considering the candidature of the
petitioners for appointment for which they have filed present writ
petitions after revision of the result. In pursuance of order dated
07.04.2026, the respondents have filed additional affidavit along
with status of vacancies in a tabular form. The table showing
status of vacancies as submitted by the respondents along with
additional affidavit is being reproduced as under:

the Hon’ble Supreme Court.
15. It is noticed by this Court that in a large number of
recruitments conducted on the basis of objective type
examinations containing multiple choice questions, grievances are
frequently raised by candidates pointing out that either certain
questions were incorrectly framed or the model answer key
prepared by the recruiting agency contained incorrect answers
contrary to authentic and standard text books pertaining to the
relevant subject. Despite submission of objections by the
candidates, in many cases such grievances are either not properly
examined or are rejected in a mechanical manner, compelling
aggrieved candidates to approach this Court seeking constitution
of an expert committee for re-examination of disputed questions
and answer keys. During pendency of such litigation,
appointments are often made on the basis of merit lists prepared
through the original answer key. However, upon re-evaluation by
expert committees constituted pursuant to orders passed by the
writ court, modifications are suggested in respect of certain
answers, resulting in revision of the answer key and consequential
alteration in the marks secured by the candidates. In several
cases, candidates who were initially denied appointment are
thereafter found to have secured higher marks than some of the
candidates already appointed on the basis of the original answer
key. Denial of appointment to such more meritorious candidates,
despite there being no fault attributable to them would be wholly
arbitrary, unjust and violative of Articles 14 and 16 of the
Constitution of India. Rights of more meritorious candidates

evaluation process attributable solely to the recruiting agency.
16. At the same time, this Court cannot lose sight of the
equally important aspect that the candidates already appointed
pursuant to the original select list had no role whatsoever in the
process of preparation of the erroneous answer key or the
consequential selection process, nor are there any allegations of
fraud, concealment or misrepresentation against them. In many
cases, such candidates have already rendered services for several
years after appointment. Therefore, the principles of equity and
balancing of competing rights are required to be invoked so as to
protect the interests of both sets of candidates.
17. Consequently, while allowing these writ petitions, it is
directed that the respondents shall determine correct number of
vacancies on the basis of guidelines given by the Division Bench of
this Court as well as by the Hon’ble Supreme Court in the case of
Namonarayan Sharma & Others (supra) and after assessing
the correct number of vacancies, the respondents shall re-
examine the claims of the petitioners afresh and, in case the
petitioners are otherwise eligible in terms of the advertisement
and are found to have secured higher marks, on the basis of
revised results, than the last appointed candidate in their
respective category, the respondents shall offer appointment to
the petitioners, subject to availability of the vacancies, after
redetermining their existence in accordance with the guidelines
laid down in the case of Namonarayan Sharma & Others
(supra) within a period of two months from the date of receipt of
certified copy of this judgment. The petitioners shall also be

entitled to notional benefits of pay fixation and seniority qua
candidates appointed earlier despite securing lesser marks,
however, without any entitlement to actual monetary arrears for
the past period. Simultaneously, it is directed that no candidate
already appointed pursuant to the original answer key shall be
terminated solely on account of subsequent revision of the answer
key, since they were not at fault.
18. However, the benefit of this judgment shall remain
confined only to the petitioners before this Court and to those
candidates, who had already approached this Court and whose
writ petitions are pending consideration. Any fence-sitter who
remained indolent and failed to agitate his rights within reasonable
time shall not be entitled to claim benefit on the basis of the
present judgment.
19. Before parting with the matter, this Court deems it
appropriate to observe that it is a matter of common knowledge
that unemployment has assumed alarming proportions in the
present era and the level of competition in public recruitments has
become extraordinarily intense. In such competitive examinations,
particularly those based upon objective type multiple-choice
questions, every single question assumes great significance, as
marks attached even to one question are capable of altering the
fate of hundreds of aspiring candidates. Therefore, the degree of
caution, fairness, accuracy and vigilance required while framing
the question paper and preparing the answer key is extremely
high. Recruiting agencies, being instrumentalities of the State,
cannot be permitted to deal with such examinations in a casual or
negligent manner. They are under a constitutional obligation to

ensure that question papers and answer keys are prepared with
utmost precision by duly consulting authentic and standard
reference books through competent subject experts, so as to
eliminate the possibility of any ambiguity or error therein.
Recurring instances of faulty answer keys and incorrect questions
not only give rise to avoidable litigation but also seriously
prejudice the careers of meritorious candidates and shake the
confidence of the public in the fairness of the recruitment process.
Accordingly, this Court deems it appropriate to direct the Chief
Secretary, Government of Rajasthan, to constitute a High Level
Committee of Senior IAS Officers under the Chairmanship of the
Secretary, Department of Personnel, for the purpose of examining
the issue in depth and formulating an appropriate Standard
Operating Procedure (SOP) and other corrective institutional
measures to ensure transparency, accountability and accuracy in
future recruitment examinations. The said Committee shall also
examine the feasibility of initiating disciplinary proceedings against
erring officials and experts responsible for preparation of defective
question papers or faulty answer keys due to negligence or casual
approach. A compliance report in this regard shall be submitted
before this Court within a period of three months for perusal.
20. All the writ petitions are accordingly allowed with the
above directions.
21. Consequent upon allowing the writ petitions, no order is
required to be passed in S.B. Civil Contempt Petition No. 92/2026
as the interim order, non-compliance of which has been alleged by
the petitioners therein, would now merge into this judgment.
