This is a suit filed by the plaintiff assignee
against the defendant company for Declaration,
mandatory injunction for rendition of accounts,
rectification of register of members and recovery of
share amount with interest and costs of the suit.
2. Brief facts of the case are as under:-
That, the Plaintiff is a Company incorporated
and registered in the year 2014, under the law of
Canada, and is engaged in the business of plastic
products and tooling. The registered office of the
Plaintiff is located at Toronto, Canada. The Defendant
is a company incorporated on 18.04.2005, under the
provisions of the Companies Act, 1956 and 2013 is
engaged in the business of manufacturing precision
plastic injection, etc. The Plaintiff is a creditor and

shareholder of the Defendant, by assignment. The
debts due from the Defendant were assigned to the
Plaintiff by Mrs. Niti Mathur by an Assignment
Agreement dated 06.06.2016. Originally, Komtch Inc.
a company registered and incorporated in Canada,
had transferred various sums to the Defendant for
purchase of various equipment and material.
