2. As gleaned from DAR read with Final Report under
section 279/338 IPC & 3/181 M.V. Act, injured Yoginder Jeet
Wats returning home in e-Rickshaw No.DL-4ER-7301 met with
an accident near Crematorium Road Cut, Telephone Exchange
Road, Samalkha, Delhi on 01.01.2021 at about 12:30 pm after
respondent Suraj Gautam driving the vehicle at high speed in zig-
zag manner lost control as a result of which the e-Rickshaw
overturned resulting in injuries in his left leg. Injured Yoginder
Jeet Wats was shifted to AIIMS Hospital, Delhi where MLC
MACT No.13/2022 Yoginder Jeet Wats Vs. Suraj Gautam & Anr. Page No. 4 of 21
No.500259372/21 was prepared recording – Crush Injury Over
Left Foot which was opined ‘grievous’.
