This complaint is filed alleging the offence
punishable under Sec.138 of the Negotiable
Instruments Act .
2. The germane facts necessary to
adjudicate this case are as follows:

Judgment
The accused being the friend of the
complainant approached him in the month of May
2019 for a hand loan of ₹ 10,00,000/- for the
construction of house and other domestic purposes.
The accused promised to return this amount within
4 months and also agreed to repay this amount
along with additional amount. Therefore ₹
8,00,000/- was advanced to the accused by way of
cash. After the lapse of promised, when the
complainant demanded his money back, the accused
issued two cheques bearing Nos.000019 and
000021 dated 10.10.2019 for a sum of
Rs.4,00,000/- each drawn on Bank of Baroda,
Anekal branch, Bengaluru.
