1. Mr. Mohd. Imran, learned counsel
for the petitioner.

2. Mr. Tumul Nainwal, learned A.G.A.
with Mr. Vijay Khanduri, learned Brief
Holder for the State.

3. By the instant petition, the
petitioner is praying for the following
reliefs:-

(i) Issue a writ order or direction in the nature
of certiorari quashing the impugned first
information report dated 12.02.2026 being
FIR No. 048 of 2026 for the offences
punishable under Section 3, 5, 6, 11(1) of the
Uttarakhand Protection of Cow Progeny Act,
2007 Police Station Kiccha, District Udham
Singh Nagar (contained as Annexure no. 1 to
this writ petition).

(ii) Issue a writ order or direction in the
nature of mandamus commanding and
directing the respondent no. 2 not to arrest
the petitioner in connection with impugned
first information report dated 12.02.2026
being FIR no. 048 of 2026 for the offences
punishable under section 3, 5, 6, 11(1) of the
Uttarakhand Protection of Cow Progeny Act,
2007 Police Station Kiccha, District Udham
Singh Nagar (contained as Annexure no. 1 to
this writ petition).

4. After arguing at length, learned
counsel for the petitioner submits that
petitioner is ready to cooperate with the
investigation and also ready to surrender
before the court concerned, however,
since the “Ramazan” is going on, the
protection may be given during this
period.

5. The State counsel has no objection.

6. In such view of the matter, instant
writ petition is dismissed as withdrawn
with liberty to the petitioner to surrender
2026:UHC:1150
before the court concerned on or before
23.03.2026. Till then, the petitioner shall
not be arrested provided he cooperates
with the investigation.
