Mr. L. Sachibhushan, learned Sr. counsel assisted by

Mr. Liya, learned counsel appeared on behalf of the petitioner; Mr.

Phungyo Zingkhei, learned Dy. GA appeared on behalf of the

respondent nos. 1, 2 & 4; and Ms. Lelina, learned counsel appeared

on behalf of the respondent no.3.

The learned Sr. counsel appearing for the petitioner

submitted that the impugned detention order has been assailed on

the ground that in the ground of detention dated 23.02.2026

furnished to the petitioner, the detaining authority, i.e., the District

Magistrate, Imphal West District (Respondent no. 1) failed to

inform to the petitioner about his right to make a representation to

the detaining authority himself as well as to the Central

Government against the impugned detention order. The learned Sr.

counsel submitted that on this ground alone the impugned orders

are liable to be set aside.

Mr. Phungyo Zingkhei, learned Dy GA appearing for the

respondent no. 1, 2 & 4 seeks some time for filing counter affidavit.

Ms. Lelina, learned counsel appearing for the

respondent no. 3 also submitted that she is yet to receive sign copy

of the counter affidavit to be filed on behalf of the respondent no.

3. Accordingly, she also seeks some time for filing counter affidavit.

In view of the ground raise on behalf of the petitioner

as narrated hereinabove, we are of the considered view that the

present petition can be disposed of on the basis of the relevant

official records/files and no counter affidavit will be required for

deciding the said issue.

In view of the above, the learned Dy. GA is hereby

directed to requisition the relevant official file and placed it before

this Court on the next date of hearing without fail. However, we

made it clear that the respondents are at liberty to file their counter

affidavit, if any, in the meantime.

List this case again on 09.04.2026.
