1. Heard Sri Radhey Shyam Tiwari, Advocate, the learned counsel for the petitioner and perused the records.
2. By means of the instant petition filed under Article 227 of the Constitution of India the petitioner has sought issuance of direction to the learned Civil Judge (Senior Division) II/ACJM, Ayodhya to decide an application under Order XXXIX, Rules 1 and 2 C.P.C. (Paper No.6-Ga-2) filed in Original Suit No.616 of 2025: Vijay Kumar Vs. Om Prakash expeditiously.
3. The petitioner has filed the aforesaid suit for specific performance of contract and he had filed an application for temporary injunction in the suit. The suit was filed on 05.05.2025 on which date notice was issued to the defendant. The service of notice on the defendant has been held to be sufficient on 08.07.2025 and the defendant has put in appearance on 10.10.2025 but thereafter, the case was repetitively adjourned and the application for temporary injunction has not been disposed off.
4. Further, this Court has issued a Circular Letter dated 16.08.2017 (C.L. No.24/Admin. ‘G-II’ Dated: Allahabad 16.08.2017) regarding time bound disposal of the interim injunction application which provides that “it is necessary that the temporary injunction application shall be disposed of within six months, failing which they shall have to record reasons in the order sheet”.

In view of the aforesaid facts and circumstances of the case, the present petition is disposed off with a direction to the learned Civil Judge (Senior Division) II/ACJM, Ayodhya to decide an application under Order XXXIX, Rules 1 and 2 C.P.C. (Paper No.6-Ga-2) filed in Original Suit No.616 of 2025: Vijay Kumar Vs. Om Prakash expeditiously in accordance with law without granting any unnecessary adjournments to any of the parties and by fixing dates at short intervals keeping in view the circular issued by this Court.
