The Criminal Petition has been filed under Section 482 of the Code of
Criminal Procedure, 1973 (for brevity ‘the Cr.P.C.,’)/Section 528 of the
Bharatiya Nagarik Suraksha Sanhita, 2023 (for brevity ‘the BNSS’) seeking to
quash the proceedings against the Petitioners/Accused Nos.1 and 2 in FIR
No.83 of 2025 of Penamaluru UPS, Krishna District registered for the alleged
offences punishable under Sections 292 and 351(2) of the Bharatiya Nyaya
Sanhita, 2023 (for brevity ‘the BNS’) and Section 175(3) of ‘the BNSS’.
2. Heard the learned counsel for the petitioners and the learned Assistant
Public Prosecutor. Perused the record.
3. The case was registered on 01.02.2025. So far, no arrest has been
effected by the Investigating Officer. The 1st petitioner is a document writer in
Sub-Registrar Office. There is political rivalry between the petitioner and the
2nd respondent.
