The petitioner is the accused in S.T.No.5/2017 on

the file of the Court of the Judicial First Class Magistrate-

III, Kanjirappally (‘Trial Court’, in short), which has been

filed at the instance of the 2 nd respondent alleging the

commission of the offence punishable under Section 138 of

the Negotiable Instruments Act, 1881 (‘NI Act’, in short).

2. The case of the 2nd respondent in the

complaint, in brief, is that the petitioner’s brother-in-law

named Raji, had borrowed money from him and the

petitioner had issued a cheque for Rs.8,00,000/-, which on

presentation to the bank got dishonoured due to

insufficiency of funds in the petitioner’s bank account.

Although the 2nd respondent issued a statutory demand

notice, the petitioner has not paid the amount. Thus, the

petitioner has committed the above offence.
