[1] Present Mr. Serto T. Kom, learned counsel for the petitioner
and Mr. Y. Ashang, learned PP assisted by Mr. A. Bheigya, learned Jr.
G.A. for the State respondent.

[2] Initially the FIR was registered under the provisions of
POCSO Act, 2012.

[3] Mr. Serto T Kom, learned counsel for the petitioner, submits
that Special Court has declared that the victim is not a minor on the date
of offence and accordingly, the case file has been remitted to the Court
of Ld. Chief Judicial Magistrate, Chandel for proceeding as per law.
[4] In the change circumstances, Mr. Y. Ashang, learned PP,
prays for two weeks’ time for filing objection.
[5] State respondents may give outcome of the DNA test, if any,
in the counter affidavit.
