Leave granted.

The appellant stands convicted by the Trial

Court in Criminal Case No.55/21 of 2019, and

seeks suspension of sentence for commission of

offences punishable under Sections 307, 323, 325,

342, 504 and 506 of the Indian Penal Code, 1860

(hereinafter referred to as the ‘IPC’). He has

been sentenced to undergo rigorous imprisonment

for 10 years with fine for the offence punishable

under Section 307, IPC; rigorous imprisonment of

seven years with fine for the offence punishable

under Section 325, IPC; rigorous imprisonment of

concurrently. His appeal against conviction is

pending consideration before the High Court.

We have heard the learned counsel appearing

for the parties.

Learned counsel appearing for the appellant

submitted that apart from the period of

incarceration undergone by the appellant, the fact

remains that the appeal is of the year 2025. The

appellant is physically disabled having both his

legs broken. The overt act is also that he

attacked his brother. Furthermore, the learned

counsel seeks relief on the grounds of parity.

Learned counsel appearing for the State

submits that considering the nature of offences,

there is no need for suspension of sentence.

We are inclined to accept the submission of

the learned counsel for the appellant that the

appeal is of the year 2025 and it would take

substantial time for its conclusion. It is not in

dispute that the appellant is a disabled man.

Furthermore, we have taken note of the overt act

attributed against the appellant, along with the

period of incarceration already undergone by him

and the fact that the sentence of the co-accused

has also been suspended by this Court.

Considering the above, we are inclined to

suspend the sentence of the appellant.

Accordingly, the sentence of the appellant is

suspended and he is granted bail, during the

pendency of the appeal in the High Court, on terms

and conditions to the satisfaction of the Trial

Court.
