By means of the present petition, the petitioners/landholders
have raised a dispute with respect to the determination of
compensation payable to them for acquisition of their lands under
the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013 made under
the award dated 15.07.2022 passed by the competent authority .

2. The grounds of challenge are three folds. The first submission
of the learned counsel for the petitioners to challenge the
correctness of the award is based upon the provisions of Section

the Right to Fair Compensation and Transparency in Land
Acquisition, Rehabilitation and Resettlement Act, 2013 (in short as
‘the Act’ 2013′) in its application to the State of Gujarat, and the
Government Resolution dated 04.04.2018 issued by the Revenue
department, Government of Gujarat prescribing procedure for
implementation of the provisions of Section 23A of the Gujarat Act,
2016.
