By way of filing present misc. petition under Section
528 BNSS the petitioner seeks to challenge order dated
15.12.2025 passed by learned Judicial Magistrate, Railmagra,
District Rajsamand in Criminal Case No.153/2020 (Gopal Lal Vs.
Suresh Garg), whereby the petitioner has been declared
absconder and proceedings under Section 82 and 83 Cr. P.C., have
been issued and he has been summoned through warrant of
arrest.
This Court has considered the arguments raised by learned
counsel for the petitioner and has perused the order dated
15.12.2025.

Counsel submits that the petitioner was not informed by his
counsel of the next date of hearing and he was assured earlier
that whenever his presence would be required, he would be
informed.
