Heard learned counsel for the petitioner and the

State .

2. Petitioner apprehends his arrest in a case registered

for the offence punishable under sections 323, 341, 307, 504,

506 and 610 of IPC and 27 of Arms Act.

3. As per F.I.R. informant alleged that on 08.08.2023 ,

all the accused persons including this petitioner armed with

weapons came and started abusing informant. It is further

alleged that co-accused Anjani Prasad fired upon informant and

other co-accused persons also assaulted him.

4. It is submitted on behalf of the petitioner that

petitioner is innocent and has committed no offence as alleged.

Specific accusation of causing firearms injury to informant is

against Anjani Prasad. So far as, this petitioner is concerned,

there is absolutely no allegation of any overt act is alleged

against him. He is simply present at the place occurrence .

5 . Learned counsel for the State opposed the bail

petition .

6 Considering the aforesaid facts, materials available

on record and other circumstances of the case , in the event of

arrest or surrender within eight weeks from today, let the

petitioner, as named above, be enlarged on bail on furnishing

bail bond of Rs.10,000/-(ten thousand) with two sureties of the

like amount each to the satisfaction of the learned Additional

Chief Judicial Magistrate – I Patna City , Patna in connection

with Fatuha P.S. Case No. 610 of 2023 , subject to the

conditions laid down under section 482(2) of the Bharatiya

Nagarik Suraksha Sanhita , 2023 .
