1. Applicant seeks regular bail in FIR No. 597/2025 dated 05.12.2025,
registered at P.S. Subzi Mandi, Delhi, for commission of offences under
Sections 221/132/121(1)/324(4)/351(3)/3(5) of Bharatiya Nyaya Sanhita
(BNS), 2023 (corresponding Sections 186/353/332/427/506/34 IPC) and
Section 27 of Arms Act.
2. As per the prosecution story, acting upon some secret information
regarding concealment of illegal arms near akhada, a police team comprising
of seven police officers reached at the spot at about 8:00 P.M on 04.12.2025.
However, they were obstructed by several persons (including the applicant

herein). It is submitted that the applicant was the one who was carrying a fire
arm in his hand and had obstructed the police team.
3. Since there was commotion, lot of public persons gathered near the
spot and therefore, few such persons, including the applicant herein, could not
be apprehended, though two other accused were apprehended from the spot.
Both such persons, who were apprehended at the spot i.e. Sonu and Krishna,
are already on bail.
4. The applicant herein was arrested on 09.01.2026 and is in custody since
then.
5. The investigational aspects are already over.
6. Learned APP for the State, who appears on advance notice and upon
instructions from the concerned IO, submits that charge-sheet is also likely to
be filed very shortly.
7. The case of the prosecution is of obstructing the police team and assault
and intimidation. Admittedly, there is no use of the fire-arm when the
abovesaid raid was conducted.
8. Keeping in mind the overall facts and circumstances of the case and
without making any observations of the merits of the case, the applicant is,
hereby, directed to be released on bail on his furnishing personal bond in a
sum of Rs. 25,000/- with one surety of like amount, subject to the satisfaction
of learned Trial Court/CJM/Duty Magistrate with the following conditions: –
(i) The appellant shall not try to contact any public witness, directly
or indirectly.
(ii) He would provide his Mobile Number to the concerned I.O and
would ensure that such Mobile Number remains active and
operational, till the disposal of the case by the learned TrialBAIL APPLN. 832/2026 2

(iii) Applicant would report to concerned SHO/IO every first Sunday
of the month at 11:00 A.M., till charges are ascertained.
(iv) Learned Trial Court would be at liberty to get the addresses of
appellant and his surety verified, before accepting the bonds. In
case, appellant wants to change his address, he shall give prior
intimation in writing, not only to the concerned investigating
officer but also to the learned Trial Court.
(v) In case, any instance of violation of the abovesaid conditions is
brought to be knowledge of this Court, the bail would be liable to
be cancelled.
9. The application stands disposed of.
10. Pending application also stands disposed of.
11. Let a copy of this order be sent to the concerned Court and also to the
Jail Superintendent for necessary information and compliance.
