1. Heard Sri Ratnesh Chandra, learned counsel for the petitioner.

By means of the present petition under Article 227 of the Constitution of India, the petitioner has prayed for a direction to the learned Civil Judge (Junior Division), Lakhimpur Kheri to decide the application dated 15.12.2025 filed by the petitioner in Misc. Civil Case No. 427 of 2025, C.R. No. 448/2025 (Gurunanak Bridh Ashram Trust Versus Lakhwinder Singh and Anr), seeking permission for irrigation of wheat crop over the property in question.

The contention of the learned counsel for the petitioner is that the learned Trial Court vide order dated 18.12.2025 directed the said application to be placed on the next date, however, on the subsequent date, i.e., 08.01.2026, ignoring the pending application, the learned Trial Court proceeded to frame the issues and fixed 26.02.2026 for disposal of the issues No. 3 & 4.

It is contended on behalf of the petitioner that at the initial stage, the learned Trial Court vide its order dated 07.07.2025 granted an interim relief by directing to maintain status-quo after finding that prima-facie the plaintiff-petitioner is the owner of the property. However, the local administration, at the behest of the respondents, is not permitting the plaintiff-petitioner to irrigate the crop standing over the property in question and in these circumstances, the plaintiff-petitioner had to move the application dated 15.12.2025 seeking appropriate direction from the Court concerned to permit the petitioner to irrigate the standing crop over the land in question.

5. Learned counsel for the petitioner has stated that the next date fixed before the Trial Court is 03.04.2026.

6. In view of the proposed order being passed, issuance of notice to the respondents Nos. 2 and 3 is hereby dispensed with.

7. Taking into consideration the fact that the application dated 15.12.2025 is still pending for consideration before the Trial Court and no objection to the same has been filed by the respondents, this Court finds no reason to keep the present petition pending.

8. Accordingly, this petition is disposed of with direction to the learned Civil Judge, (Junior Division), Lakhimpur Kheri to decide the application dated 15.12.2025 filed by the petitioner in Misc. Civil Case No. 427 of 2025, C.R. No. 448/2025 (Gurunanak Bridh Ashram Trust Versus Lakhwinder Singh and Anr), strictly in accordance with law, after affording due opportunity of hearing to the parties concerned, expeditiously; preferably by the next date fixed in the case, if there is no legal impediment.
